Application of these terms
These Terms of Sale apply to every vehicle sold by Enclosed Mobility Scooters unless we have signed a separate written supply agreement with you. They prevail over any purchase-order conditions you may issue unless we have expressly accepted those conditions in writing.
Quotations
Written quotations are valid for the period stated on the quotation. Where no period is stated, quotations are valid for 14 days from the date of issue, because vehicle prices, depot stock and haulage rates move frequently.
A quotation is based on the information you supply. If the vehicle specification, quantity, destination or site access changes, the quotation may be revised.
Acceptance of order
All orders are accepted subject to availability at the time of confirmation. We confirm your order once the unit is allocated and, where applicable, payment is received.
Where a unit is no longer available we will contact you to offer an equivalent alternative or arrange a full refund. We may also decline an order where the delivery location is not serviceable or where payment cannot be verified.
Condition grades
New / factory-new: manufactured and not yet used to carry cargo.
One-trip: manufactured new and used for a single loaded voyage. Near-new appearance with minor transit marks.
Cargo-worthy: certified as structurally sound and suitable for international shipping, with visible cosmetic wear.
Wind & watertight: structurally sound and dry inside, suitable for storage, but not certified for shipping line use.
Used / as-is: sold on the basis of the description and photographs provided for that specific unit.
The grade shown on the product page is the grade supplied. Grades describe condition, not appearance, and cosmetic variation within a grade is normal.
Payment
Two payment methods are offered: credit card by secure payment link issued after your order, and bank transfer using the instructions provided with your order confirmation.
Orders are processed once payment is confirmed as cleared. For bank transfers, the customer is responsible for any sending or intermediary bank charges so that the full invoiced amount is received.
We will never contact you to change bank details mid-order. If you receive such a request, do not act on it — contact us using the details published on this website to verify.
Title and risk
Title in the goods passes to you only on receipt of cleared funds in full for the vehicle and any associated charges.
Risk passes to you on delivery, or on collection where you or your carrier collect from the depot. From that point insurance of the unit is your responsibility.
For export orders, specific title and risk terms (including applicable Incoterms) are confirmed in writing at the time of the order.
Delivery and timeframes
Delivery is quoted separately from the vehicle price and is arranged in accordance with our Shipping & Delivery Policy.
Delivery dates given are estimates based on depot location, haulier availability and site access. Time is not of the essence unless we have expressly agreed a guaranteed date in writing.
Inspection and acceptance
You are encouraged to inspect the vehicle on delivery or collection, before the vehicle departs where practical: check the doors open, close and seal; check the floor and roof; and check the unit matches the type, size and grade ordered.
Any discrepancy against the ordered specification should be reported promptly with photographs so it can be investigated while the evidence and haulage record are fresh. Claims raised after modification, painting, cutting or relocation of the unit are significantly harder to assess.
Modifications and intended use
Where a vehicle is to be modified — doors, windows, insulation, electrics or conversion — the suitability of the base unit for that work is your responsibility unless we have supplied it as a specified conversion.
Siting a vehicle may require planning permission, landlord consent or a permit. Obtaining those is your responsibility, and their absence is not a ground for return.
Taxes, duties and export
Applicable taxes, duties, port charges and levies are the responsibility of the customer unless expressly stated otherwise on the order.
California sales tax is applied where required. For export orders, import duties, customs clearance costs, port charges and destination taxes are the customer's responsibility unless expressly agreed otherwise in writing.
Force majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including port congestion, extreme weather, strikes, carrier failure, sanctions or changes in law. We will keep you informed and, where a delay becomes unreasonable, offer an alternative or a refund.
